A. Terms and conditions for ONLY STORES customer club
An ONLY STORES Membership is for you who loves Fashion!
A digital ONLY STORES Membership gives you access to a number of benefits, where you, among others, earn points every time you shop at your local ONLY store orwww.only-stores.com. The membership also provides access to bonus rewards, exclusive offers, events, digital receipts, contests and much more.
The Customer Club is managed by ONLY STORES A/S Fredskovvej 5, 7330 Brande, Denmark (”ONLY STORES”). By accepting these Terms and Conditions for ONLY STORES Customer Club, you are entering into a legally binding agreement with ONLY STORES.
Please note that the ONLY STORES customer club, including member benefits, does not apply to www.only.com.
General information about ONLY STORES Membership
An ONLY STORES membership is personal and you must be at least 16 years old to become a member. Membership is geographically limited and only available in Denmark. Employees and other persons associated with Bestseller are excluded from earning points and other club benefits.
How it works
Sign up
Become a member by signing up via the ONLY STORES app or on www.only-stores.com.
Earn points
Earn points by shopping in a physical ONLY store or on www.only-stores.com, through games and campaigns, and by updating your member profile.
Each purchase of 1 DKK gives you 2 points. Each time you earn 2,000 points, it triggers a 25 DDK bonus reward. Please note that you do not earn points on gift card purchases.
Points earned on a purchase will be deducted if you return the item(s). You can view your points balance at any time in the member app or in your online member account.
To earn points, you must be logged in to your account when shopping online and in our physical stores you must provide your member ID before making a purchase.
The points you earn are personal and cannot be transferred to another person or member. In case of suspected fraud or abuse, we may suspend or cancel your membership.
Please note that it is not possible to earn points when shopping on only.com
ONLY Bonus Rewards
You receive a bonus reward of 25 DDK for every 2,000 points you earn. Your bonus reward will be available within 24 hours after reaching the point limit. A bonus reward is valid for a minimum of 90 days from the date of issue. The validity is stated on the individual bonus reward.
A bonus reward can be redeemed in our physical ONLY stores or at www.only-stores.com and is converted into a discount that is deducted from the purchase price.
The bonus vouchers cannot be exchanged for cash or used to purchase gift cards, and you will not get your voucher back if you return an item purchased (partially) with a bonus voucher. The bonus voucher acts as a discount and in the event of a return, you will be refunded the amount you actually paid. If you purchase more than one item when using the voucher, the discount will be split between the items.
You can see your active bonus rewards under "MY ONLY" in the app or via your online member account.
Please note that bonus rewards cannot be used on only.com
ONLY Elite Member
Earn more points and get more out of your ONLY STORES membership. When you earn 4,000 points within a year, you become an Elite Member. As an Elite Member you get access to even more exclusive benefits, e.g., campaigns, events and more.
Your ONLY STORES Elite Membership is valid for 1 year from the time you achieved ONLY STORES Elite Member status.
As soon as you have achieved Elite Member status, your points will be reset and you will earn points again. If you have earned 4,000 points before your Elite Membership expires, your Elite Membership will be renewed for a period of 1 year from the day you qualified for the renewal.
Cancellation of ONLY STORES Membership
You can terminate your membership at any time. In the app, you can cancel your membership under "MY ONLY". Online you can cancel your membership by logging in to your account and selecting "delete account". You are also welcome to cancel your membership by contacting us at OnlyStoresSupport@Bestseller.com. Upon cancellation, earned points, bonus rewards and promotions will be deleted.
Please note that if you have also signed up for the ONLY STORES newsletter, you will automatically be unsubscribed from the newsletter if you cancel your membership of the ONLY STORES Customer Club.
If you are a member of both the ONLY STORES and ONLY.com Customer Clubs, you must cancel each membership separately. Cancelling one membership will not affect the other. Separate cancellation is required for each club.
Changes and termination
ONLY STORES reserves the right to change these Customer Club Terms & Conditions or completely terminate the ONLY STORES Customer Club. Any changes to the terms & conditions will be considered accepted by your continued use of your ONLY STORES Membership. Substantial changes and termination will be notified in writing and by giving 1 month’s notice. In case of termination, any earned points that have not triggered a bonus reward at the time of termination will expire and any earned bonus reward must be redeemed before the termination of the ONLY STORES Membership comes into effect.

B. NEWSLETTER - TERMS AND CONDITIONS AS WELL AS PRIVACY POLICY
These terms and conditions apply to the ONLY STORES newsletter. It’s non-binding and you can, at any time, cancel your subscription. When signing up, you have to be a minimum of 16 years old. If you are not, you need to have a legal guardian send us a signed petition, confirming your permission to receive our newsletter. This can be sent to OnlyStoresSupport@Bestseller.com.
When signing up, you consent to ONLY STORES A/S, Fredskovvej 5, 7330 Brande, Denmark, may send you our marketing via email, SMS, MMS and on social media like Facebook, Instagram and such. It will contain:
• Clothes, shoes, bags, accessories, designs and similar
• Offers, sales, competitions, events and other marketing activities
• Information about products you have added to your wishlist or basket
You furthermore accept that this consent can be used to request you to update your consent to include relevant products, brands, partners or communication channels.
You can, at any given point, unsubscribe the newsletter or withdraw your consent to receive marketing, by following the instructions in the newsletters we send you or by contacting us at OnlyStoresSupport@Bestseller.com. Please also note that you will automatically be unsubscribed from the newsletter if you cancel your ONLY STORES Customer Club membership.
If you have subscribed to ONLY.com’s newsletter, please note that withdrawing your consent for the ONLY STORES newsletter does not affect your consent to receive newsletters from only.com and vice versa. Therefore, it is necessary to unsubscribe from ONLY.com's newsletter and ONLY STORES’s Newsletter separately.
C. PRIVACY POLICY
This privacy policy covers the processing of the personal data that we collect or you provide when signing up to, and using your, membership of the ONLY STORES Customer Club.
ONLY Stores A/S (Fredskovvej 1, 7330 Brande, Denmark) is the data controller for the personal data covered by this privacy policy.
1. COLLECTION AND USE OF YOUR PERSONAL DATA
Your membership
When signing up to the ONLY STORES Customer Club, or updating your profile, you submit certain personal information. E.g. this could be your name, address, email, phone number or birthday.
When shopping in a physical ONLY store or on www.only-stores.com we collect information about your purchases, so we can reward you with points and bonus-rewards.
When you sign up and create a member profile, we create a member-ID. This will be visible in your app and secure that the app is functional. We will comply with the Cookie Policy and you can read more about these in our cookie-section below.
The legal basis for processing your personal data is your membership agreement, cf. GDPR Article 6(1)(b) and our legitimate interests in providing customer service, cf. GDPR Article 6(1)(f).
Membership benefits
We use your personal data to provide you with the various benefits associated with your membership. Depending on the benefits, additional information may be collected and registered on your profile, e.g. points, vouchers, etc.
The legal basis for processing your personal data is your membership agreement with ONLY STORES, cf. GDPR Article 6(1)(b).
Digital receipts in our app
In the app, you can choose to save digital receipts from your purchases in our stores. The processing of your data in this context is based on your consent when you sign up for this service, cf. GDPR article 6 (a).
You can at any time unsubscribe from the service and withdraw your consent to ONLY STORES storing your digital receipts by deactivating digital receipts in the app. In that case, you must go to “MY ONLY” and then “app settings”. You are also welcome to unsubscribe to this service by contacting us at OnlyStoresSupport@Bestseller.com.
Please note that your digital receipts will be deleted, and we will not be able to recreate the receipts at a later date - not even in connection with a complaint.
Improvement of your userexpierence
We will at all times strive to give you the best experience in our app. We’ll do that in several ways, but an important part of this is looking closely at how you use the app. By doing this we can improve user experience, ease of use, the app layout, it’s functionality and lastly the whole experience of the app.
Our collection of information about your activities in the app is based on your login in app and the legal basis behind our legitimate interests cf. GDPR art.6,1(f).
Marketing
To be able to present you with the best styling- and fashion advice, most relevant news and general marketing, communication and advertising, we use your personal data to personify your recommendations and promotions. We furthermore use this to make sure you receive relevant communication, marketing and advertising on other websites and social media.
You can always object to our collection and management of your personal data regarding direct marketing, communication and advertising purposes, including profiling by contacting us at OnlyStoresSupport@Bestseller.com.

I Personalizing
In order to personalize our product recommendations and promotions, we base these on your activity in our app, in our webshop as well as your purchases in ONLY's physical stores. We register your style and product preferences and track which adverts you have already seen, how many times you have seen them and whether you have clicked on any of the adverts. If you have subscribed to our newsletter, this information will also be used to personalize the content of the newsletters we send you.
The legal basis for our processing of your data is our legitimate interest in offering you a better personalized service and more relevant product information, cf. GDPR art. 6, 1 (f). Information obtained via cookies is processed for marketing purposes based on your consent, cf. GDPR article 6, 1(a).
II ONLY STORES newsletter
We process your personal data to make sure we send you relevant marketing, including campaign offers, news, invitations, birthday rewards and so forth. We do this to optimize you shopping experience with us by sending you, based on your data, relevant marketing that match your interests.
We process the data you provide us via the app and online. Amongst this is your name, email, birthday and phone number. Furthermore, we process information about your purchases and your activity in our app and online, like products on your wishlist and in your basket. We may also measure your activity when you receive our newsletters.
The legal basis for this is your consent, cf. GDPR article 6,1 (a). You can unsubscribe from the newsletter and withdraw your consent to receive marketing at any time by following the instructions in the communications we send you or by contacting us on OnlyStoresSupport@Bestseller.com.
Please note that if you choose to withdraw your consent to receive newsletters, your membership of our customer club and any membership benefits included in your membership will not automatically terminate, unless other terms are stipulated for the specific membership benefit.
Furthermore, you can at any time object to our processing of your personal data for direct marketing. In that case, you can contact us at OnlyStoresSupport@Bestseller.com.
III Push notifications
In our app you can choose to receive push-notifications about campaigns etc. from us. The legal basis is your consent, cf. GDPR article 6,1(a).
You can, at any given time, deactivate push-notifications in the settings in the app or in your phone’s settings.
Fraud Prevention
If we suspect misuse of your membership or fraud in connection with membership benefits or related payments, we will use your personal data to conduct an investigation. The legal basis for processing your personal data is our legitimate interest in preventing and detecting irregularities that may lead to losses for us or third parties, cf. GDPR article 6, 1 (f).
Analysis and statistics
Your information may be included in various analyses and statistics that we use to understand and develop our products and services, but in most cases your personal data will be aggregated or anonymised.
The legal basis for processing your personal data in connection with analyses and statistics is our legitimate interest in understanding and developing our business, cf. Article 6(1)(f) of the GDPR.
2. Sharing of personal data
To offer you different services, we will share personal data with our partners (data processors), who will only process your data on our behalf and in accordance with our instructions.
Our partners include technical service providers, that process your personal data when they have access to our database or host personal data on our behalf.
We will share your personal data with public authorities and other parties if we are legally required to or if a court or other authority has decided hereby.
3. Transferring data outside the EU
Some of your personal data may be handled by our partners (data processors) outside the EU. In such case we always ensure that your personal data is still governed by an adequate level of data protection. Currently, some of our partners are located in the USA and the data transfers are safeguarded by the EU-US Data Privacy Framework or the EU Commission’s Standard Contractual Clauses.
In addition, some of our partners may use subcontractors (sub-processors) located outside the EU. In such case, our partner is obligated to keep your personal data equally safeguarded. 4. Dataretention
We only store your personal data for as long as it is necessary to fulfill the purpose it was collected for, to determine, practice or defend legal requirements or to comply with legal requirements. When this is no longer the case, the information will be deleted.
You can also ask us to delete the personal information we have registered about you, by contacting us at OnlyStoresSupport@Bestseller.com. We will comply with your request, unless we are legally obliged to retain them or the information is relevant in an imminent or ongoing case, legal action and similar.
5. Your rights

Right to access
One of your most important rights is the right to access the data we have registered about you. If you wish so, you will receive a copy of your personal data.
The right to be forgotten
Another important right you have is to be forgotten. This means that you have a right to request us to delete any information we have about you. We might not be able to delete all information, because we are legally obliged to store certain data in order to comply with legal requirements or to establish, defend or exercise legal claims.
The right to objection
You are entitled to object to the processing of your personal data on certain grounds. For example, you can object to the processing of your personal data for direct marketing purposes, including profiling.
The right to rectification
If you think that the information, we have registered about you is incorrect or incomplete you can let us know, so we can update the information.
The right to limitation
In combination with your other rights, you can request us to limit the usage of your personal data. E.g. instead of complete deletion of your data or during our assessment of your objection.
The right to data portability
You can request us to deliver the personal data we have collected about you in a structured, common and machine-readable format and to transmit the information directly to a predetermined recipient.

D. COOKIE POLICY FOR THE MEMBER APP
In our app we use a technology similar to cookies. To make it easy we will, in the following and in the privacy policy, be calling it cookies.
A cookie is a datafile that is stored on your device. It makes it possible to recognize your device via an ID, that is assigned your membership. This recognition will secure that our app can function, and the usage runs smoothly and without delays.
